This month, the Kentucky Supreme Court said that it will not hear a long-disputed case involving a proposed condominium development in the Highlands area of Louisville. The case involved plans for a 15-story, 24-unit condominium in the upscale Cherokee Triangle area of the city overlooking Cherokee Park. Construction can now proceed.
Other property owners in the area, including the Cherokee Triangle Association, filed lawsuits against Kevin Cogan over his proposed Willow Grande development. They argued that the building, which will be the tallest in the area, will be detrimental to Cherokee Triangle’s historic charm.
Others more directly impacted by the development are residents of Bordeaux Apartments, which currently sits on the site where Willow Grande will be built at Willow and Baringer Avenues. They’re going to have to find somewhere else to live before the apartment complex is torn down.
An attorney for the developer says, “Four different lawsuits to delay a project that’s been approved by the people elected by the public to do such approvals is crazy.” He also called the lawsuits “abusive.”
In fact, Cogan has a suit of his own against the neighbors who fought long and hard to prevent the project from moving forward. He’s suing them for malicious litigation. His lawyer says, “We’ve been damaged to the extent of over $1 million.” If Cogan wins that suit, the people who sought to stop the development could end up helping to pay for it.
